Terms of Service

Please read these Terms of Service carefully before utilizing TenantAI. These terms outline your legal rights, platform limitations, permitted self-representation uses, and statutory disclaimers.

Mandatory Regulatory Notice: Self-Representation Technology Tool

No Legal Advice / Self-Representation Tool: TenantAI is an autonomous legal software tool designed exclusively to empower self-represented litigants under the Statutory Powers Procedure Act (SPPA) and the Ontario Residential Tenancies Act, 2006 (RTA). TenantAI is not a law firm, does not act as legal counsel, and does not provide formal legal advice or representation. Use of this platform does NOT establish a solicitor-client or paralegal-client relationship under the Law Society Act (Ontario).

TenantAI provides deterministic statutory calculations, document organization, timeline reconstruction, and self-help workflow tools for tenants exercising their statutory right of self-representation before the Ontario Landlord and Tenant Board (LTB).

1.Acceptance of Terms

By accessing, browsing, or utilizing TenantAI V2.0 (including the conversational legal defense agent, Notice Auditor, Bates Stamping engine, Pocket Wiretap, or Disclose & Serve module), you affirm that you have read, understood, and agreed to be bound by these Terms of Service.

If you do not agree to these terms, you must immediately terminate your session and refrain from utilizing our software or generated tribunal exhibits.

2.Permitted Use for Self-Represented Litigants

Under Section 10 of the Ontario Statutory Powers Procedure Act, a party to a tribunal proceeding is entitled to be self-represented. TenantAI is licensed strictly as a deterministic self-help productivity tool for personal tenant advocacy governed by the Ontario Residential Tenancies Act, 2006 (RTA) and proceedings before the Ontario Landlord and Tenant Board (LTB).

Permitted Uses Include:

  • Auditing statutory dates and delivery buffers on landlord notices (Forms N4, N5, N12, N13).
  • Executing deterministic mathematical calculations for proportional rent abatements and out-of-pocket damages under RTA Section 130 and Section 30.
  • Compiling chronologically indexed, Bates-stamped master evidence briefs for administrative hearings.
  • Generating Bay Street formal response drafts and statutory dismissal notices to landlords.
  • Simulating cross-examination questions to prepare for LTB virtual dispute resolution hearings.

3.Evidence Integrity & Strict Anti-Perjury Prohibition

TenantAI maintains zero tolerance for evidence fabrication, altered timestamps, or tribunal fraud. Under the Canadian Criminal Code (R.S.C. 1985, c. C-46):

Statutory Perjury & Evidence Tampering Warnings:
  • Section 137 (Fabricating Evidence): Every one who, with intent to mislead, fabricates anything with intent that it shall be used as evidence in a judicial proceeding is guilty of an indictable offence.
  • Section 139 (Obstructing Justice): Intentionally falsifying evidence or concealing required disclosures is punishable by criminal indictment.

Users are strictly prohibited from using TenantAI tools to fabricate receipts, edit dates on landlord notices, or modify photo exhibits. TenantAI reserves the right to terminate accounts that upload visibly altered evidence.

4.One-Party Consent & Doorstep Encounter Recording

Under Canadian Criminal Code s. 184(2)(b), recording an in-person or telephone conversation without the knowledge of the other party is lawful provided that at least one party to the conversation (the tenant) consents to the recording.

You agree that when utilizing TenantAI acoustic tools (including Pocket Wiretap):

  • You will only record encounters that you are personally participating in.
  • You will not place unattended surveillance devices in areas where third parties possess an expectation of complete privacy.
  • You understand that LTB adjudicators maintain discretion over the weight and relevance of admitted audio recordings.

5.Limitation of Liability & Disclaimers

To the fullest extent permitted by Ontario law:

  • TenantAI is provided on an "AS-IS" and "AS-AVAILABLE" basis. We disclaim all warranties, express or implied, including merchantability and fitness for a particular tribunal hearing.
  • TenantAI does not guarantee specific hearing results, dismissal of eviction applications, or particular financial abatement sums, as tribunal members possess broad equitable discretion under Section 83 of the RTA.
  • In no event shall TenantAI, its developers, or affiliates be liable for indirect, punitive, or consequential damages, eviction enforcement orders, or tribunal cost awards.
  • Our maximum aggregate liability for any claim shall not exceed the actual amounts paid by you to TenantAI in the preceding twelve (12) months or $50 CAD, whichever is greater.

6.Billing, Fees & Certified Mail Costs

TenantAI offers free legal triage, document review, and dispute organization. Premium services are governed by the following billing terms:

  • Tribunal Defense Pass: One-time flat fee ($49 CAD per dispute) granting unlimited master PDF export, audio transcription, and Bates stamping. Once generated, digital files are non-refundable.
  • Certified Physical Mail (Lob API): Hard costs calculated per envelope and page count plus standard service margin. Postage charges are non-refundable once envelopes are batched for Canada Post delivery.

7.Governing Law & Judicial Forum
